Eulis Simien, Jr., Jimmy Simien Secure $4.4 Million Wrongful Death Verdict
Simien & Simien is pleased to announce that founding partner Jimmy Simien and partner Eulis Simien, Jr. secured a $4.4 million verdict in a wrongful death lawsuit filed by David and Shayla Lanus, whose two children were struck and killed by an SUV on July 24, 2014.
The accident occurred on Bluff Road south of Interstate 10 in Ascension Parish. The SUV driver lost control of the vehicle when its wheel veered off the roadway and she was unable to recover from the steep embankment. The vehicle plowed into a group of people fishing at a nearby bayou.
The group included David Lanus and two of his friends, along with his son and daughter. The collision killed the two children and sent all three adults to the hospital.
The lawsuit alleged that the Louisiana Department of Transportation and Development was negligent in designing and maintaining the roadway embankment which was the primary cause of the fatal accident. As Eulis Simien stated, “Despite the fact that Department of Transportation and Development pointed fingers everywhere else, including at the Lanus family, the jury found that the department’s actions were the primary cause of this tragedy. Mr. and Mrs. Lanus find comfort and can start the process of healing and closure, knowing that the department has been told that it needs to correct this problem and hopefully avoid another tragedy in the future.”
The jury agreed and sent a message that the roadway embankment is dangerous and needs to be fixed to prevent others from being injured or killed, says Eulis Simien, Jr.
